近年来,随着房地产市场的活跃,房屋建筑工程质量投诉日益增多,商品房质量已成为社会关注的一个热点和难点问题。这说明我们的社会在进步,老百姓的维权意识在逐步提高,当然也说明了工程质量确实有诸多问题,有待改进。
据统计,住宅工程质量投诉主要集中在以下几类:
①房屋裂缝;②渗漏;③抹灰层脱落;④房间内几何尺寸和门窗几何尺寸。
建筑工程作为一个特殊的商品,由于其施工周期较长,使用的材料物理性能存在差异,施工工序繁杂和手工操作,以及工程和施工管理等方面的原因,发生质量缺陷的可能性客观存在,所以,发现质量问题,有关责任方应认真、及时、有效处理,可有效避免矛盾,否则,会形成矛盾升级等不和谐的社会问题。
笔者作为一个长期从事监督一线工作的工程质量监督人员,曾处理过各种各样的质量投诉问题。下面,就在处理投诉过程中用户的一些疑点和对今后投诉工作的管理做一些思考和分析。
1.商品房要经过怎样的验收程序后方能交付给用户
地产商自己对自己的商品房进行工程验收是否合理合法?这是遇到的用户问的频次较高的一个问题,也是一些开发商掩饰自身的违规交房行为的一种说法。这种说法是不严谨、不准确的。《建设工程质量管理条例》第十六条规定:“建设单位收到建设工程竣工报告后,应当组织设计、施工、工程监理等有关单位进行竣工验收。”建设工程竣工验收应当具备下列条件:
①完成建设工程设计和合同约定的各项内容;②有完整的技术档案和施工管理资料;③有工程使用的主要建筑材料、建筑构配件和设备的进场试验报告;④有勘察、设计、施工、工程监理等单位分别签署的质量合格文件;⑤有施工单位签署的工程保修书。
建设工程经验收合格的,方可交付使用。从以上看出,房地产商自己对自己的商品房进行工程验收,这个说法是不准确的,不是房地产商自己对自己验收,是房地产商组织相关责任方进行验收。
那么,既然是房地产商组织相关责任方进行验收,监督机构对竣工验收如何监管呢。《房屋建筑工程和市政基础设施工程竣工验收暂行规定》(建建〔2000〕142号)第四条规定:“工程竣工验收工作,由建设单位负责组织实施。县级以上地方人民政府建设行政主管部门应当委托工程质量监督机构对工程竣工实施监督。”首先,工程在竣工验收以前,监督人员会对工程是否具备验收条件进行检查,符合要求后,才可以组织竣工验收。验收时,监督人员到场对工程竣工验收的组织形式、验收程序、执行验收标准等情况进行现场监督,发现有违反建设工程质量管理规定行为的,责令其改正,并对工程实体质量按照一定的比例进行抽查,对存在的质量问题提出整改意见,督促相关责任方整改。
近年来,有很多用户提出了这样的问题:工程还没有进行竣工备案,开发商就交房了,这样是不是不合法?对于这个问题,笔者认为很有必要讨论一下。刚才提到《建设工程质量管理条例》第十六条规定:“建设工程经验收合格的,方可交付使用。”那么,什么程度才是验收合格呢?对此,国家的相关法律、法规未做出明確的解释,使得在此方面有很多的理解和争议。在郑州市,按照常规的做法,工程组织竣工验收后,验收组和监督机构提出的整改意见全部落实完毕,各方达成了综合的验收意见并在《工程竣工验收意见表》上签章,建设单位将《工程竣工验收意见表》报送至监督部门,并经监督部门接受后,工程才可交付使用。有个别开发商,给用户看的《工程竣工验收意见表》和给监督部门报送的所签署的时间不一致,甚至还没有竣工验收,竣工验收意见就已经签署了,用户若发现有这样的作假行为,可以向有关部门举报。
2.对于验收合格的工程,如何对待用户提出的质量问题
不少用户提出这样的疑问:工程已经验收合格了,为什么还有质量问题?对于这样的质疑,笔者认为开发单位有责任也有义务向用户作出解释:工程评定为合格,并不表示工程就不能存在质量问题,国家的验收规范规定出现严重质量缺陷不能评定为合格,而一般质量缺陷点不超过总检查数量的20%时,可以验收通过。并且质量问题也不是固定在一个时期出现的,竣工验收时可能没有出现,但在使用中出现了。所以,对于工程竣工交付使用后出现的质量问题,国家实施质量保修制度,施工单位必须严格履行保修义务。
用户发现质量问题,如果在保修范围和保修期内,应向开发商或物业反映,由建设单位通知施工单位进行整修。如果建设单位和施工单位不履行保修义务,用户可以向建设行政主管部门进行投诉,由政府部门协调解决。遇到用户反映质量问题,相关责任单位的工程技术人员首先应该察看并进行初步判断,是否是质量问题,若是质量问题,应进一步判断是一般质量问题还是严重质量问题,若是严重质量问题,经处理后工程应该重新验收,若是一般质量问题,则应及时进行维修。
3.如何从根本上解决质量投诉问题
3.1应建立工程质量保险体系。房屋是一种特殊的商品,不像其他的商品,可以做到全面机械加工,而房屋是用人工建起来的,偏差较大,精确度达不到机械加工的精度,这也是工程存在质量问题的一个很重要的原因。用户在使用房屋的过程中,发现质量问题,在保修期内可以保修,那在保修期以外呢?房子属于贵重的商品,一套房子的价格动辄就是几十万、上百万,如果质量保险体制建立起来,那无论什么时候出现质量问题,都可以得到妥善解决。目前,这种制度在发达国家已经日臻完善。
3.2要建立开发企业的信用体制,对于不诚信的开发单位,通过媒体曝光,使用户可以擦亮眼睛,不去选择那些开发商开发的房子。目前来说,政府对开发单位的诚信体制建立不完善,对不诚信开发单位还缺乏有效的制约,只有政府机制和市场机制联动起来,才能起到较好的效果。
3.3要全面实施住宅工程分户验收制度。实行住宅工程分户验收,对提高住宅工程质量水平是一个比较有效的制度。该制度是指在工程主体分部和单位工程竣工验收前,依据国家质量验收规范、省市有关技术标准及经审查合格的施工图设计文件,对住宅工程每一户分别进行的逐户逐间的专门验收,并在验收合格后填写分户验收合格证书的行为。这种制度可有效的约束参建方的行为,弥补按照国家验收规范进行的抽点验收可能钻的空子。
